This commercial license was created for (Name of Member--you will receive a personalized license upon completion of registration within 24 hours) ONLY and covers all items downloaded from Lowcountryscrapper.com or obtained on a CD that was purchased through this website. By purchasing this license, you also receive a lifetime membership to this site (lowcountryscrapper.com) If you ever decide to cancel your subscription, this license covers any items downloaded or received on CD/DVD before the cancellation date and is valid forever only on those items. Your personalized license will override any TOU file you may receive within the zipped files of items downloaded from this site.

This license is not transferable.

COMMERCIAL LICENSE AGREEMENT/USAGE TERMS:
The graphic files contained in this e-file or CD/DVD are the product of Nicole E. Perry. The single individual Purchaser (meaning, the individual who actually bought the product) may use, copy and modify these files for their own small business use. Where applicable, the terms “this site” and “obtained here” mean on lowcountryscrapper.com and from the original designer, Nicole Perry.

You may design derivative work that you will personally sell or profit from as a result of your design work using the licensed materials. There is no limit on how or where you may sell your designs. You may sell them in printed form or digital via online or other venue. There are no restrictions on selling your designs on e-bay or other online venues as long as they adhere to this license.
These files - which are to be considered a design tool rather than a final design product and are licensed to the purchaser's computer only and are not to be shared, loaned, rented, resold, distributed, transferred, or posted across a bulletin board, network, modem, Internet or web page in their original form. The purchaser has a license to create derivative designs using these files - but is not licensed to re-distribute them in their original format.
A good example of correct usage would be just like if you were to go to your local craft store and purchase a paper kit. You can use that paper to create whatever you want and resell it but you cannot take the original paper, repackage it and sell it as your own. Same rules apply with all digital designs obtained from lowcountryscrapper.com under this license.

You may:
1. Use the individual items to create items to sell, whether in digital (i.e. new digital designs) or hard copy (i.e. albums, candy wrappers, cards, invitations).
2. Use the individual items to create new and different items (I.E. You may use a texture to create papers or new embellishments)
3. Combine individual items to make new and different items (i.e. combine papers together to make new paper designs or make a tag by combining elements and papers).
4. Use the designs and graphics obtained from this site for designing personal or commercial websites or games. If you are using the designs and graphics obtained at lowcountryscrapper.com in their original form, you must credit the copyright holder. (On a side note, you will need to resize the graphics to be appropriate for web usage. This does not constitute modification in which you may call the designs your own.)
Anything you create must be uniquely different than the original designs.

You may not:
1. Rename and repackage anything obtained on this site and resell or give it away, claiming it as your own in its original design.
2. Alter the individual files and resell them as your own (i.e. changing the color of a button or changing the size of a tag).
3. Giving away these items in their original design to anyone in any format.
4. Allow anyone to use your name or personal account information to log in to this website or use anything you have downloaded here. If anyone is interested and would like to use my designs for their own use, please direct them to this site to purchase their own account.

You do not have to credit me for any of my designs used but I wouldn’t hold it against you. :)

Do not make copies of these files on any electronic or physical medium (including CDs, diskettes, or other storage medium) for reasons other than back-up purposes. Do not share these products with anyone. Do not purchase these products as gifts for anyone. They MUST be purchased by the individual designer who will be using them or it will be considered that the individual using the designs has broken the copyright.

No Refund Policy

Because our Web site has implemented the Instant Payment Notification (IPN) system through Sentry Login Solutions ,which allows images to be downloaded immediately after paying the Membership fee, without any exception, we have an absolute NO REFUND policy. Only Exception to the No Refund Policy

In the event that you have technical issues with this website and cannot log in, all efforts will be made to correct any problems. If, after 24 hours, these issues still persist and you are still unable to gain access to the membership area after logging in, a full refund will be made. In order to qualify for a refund, you must contact me within 12 hours of registration and payment and it must be proven that you cannot successfully log in or no refund will be offered

If a company, partnership, LLC, or corporation is interested in obtaining commercial licensing for this product, please
contact Nicole E. Perry (see contact information below) and appropriate terms will be negotiated.

Licensee hereby acknowledges that Licensee is licensing the Software for commercial use as described. Licensee hereby agrees to pay liquidated damages to Licensor in the amount of $5,000.00 for any non-allowed commercial use. In addition, should Licensor incur any attorney fees or other costs in collecting and/or enforcing this liquidated damages provision, Licensee agrees to reimburse Licensor for all such fees and/or costs. The parties acknowledge that the liquidated damages set forth above are reasonable in amount, that actual damages would be extremely difficult or impractical to determine and that any dispute or potential dispute over actual damages would be disruptive to the businesses of the parties so that it is in both parties’ best interest to have determined the amount of such reasonable liquidated damages.
